⸻ New Jersey Law

Why your POA must be
notarized in New Jersey.

Under N.J. Stat. § 46:2B-8.9, a financial power of attorney must be signed in the presence of a notary public to be valid in New Jersey. Without notarization, banks, financial institutions, and healthcare providers may refuse to honor the document — leaving your loved one’s affairs unprotected at the most critical time.

Important: Don't sign before the notary arrives
The notary must witness the signing. If the document is already signed when we arrive, we cannot notarize it. Please have your documents prepared but unsigned until your notary is present.

Types of POA We Notarize

Most Common

Durable Power of Attorney

Remains in effect if the principal becomes incapacitated. Allows an agent to handle financial affairs, sign documents, manage bank accounts, and conduct legal transactions on your behalf.

Healthcare

Healthcare POA (Proxy Directive)

Appoints someone to make medical decisions on your behalf if you are unable to do so. In New Jersey, this is governed under the Advance Directives for Health Care Act.

Estate Planning

Living Will (Instruction Directive)

States your wishes for end-of-life medical treatment, resuscitation, and life support. Provides clear direction so your family does not have to make these decisions in a crisis.

Specific Purpose

Limited Power of Attorney

Grants authority for a specific task or time period — such as signing real estate documents, managing a single transaction, or acting on your behalf while you are traveling.

⸻ Optional Upgrade

Need more than just a POA?
The Estate Package — one visit.

If you need a Power of Attorney notarized on its own, we start at $150 and come straight to you. But if your family also needs a living will and healthcare directive — which most estate planning attorneys recommend — our $250 Estate Package covers all three documents in a single visit, saving you time and money over booking separately.

Power of Attorney

Financial and legal authority for your appointed agent — to manage accounts, sign documents, and act on your behalf if you become unable to do so.

Living Will (Advance Directive)

Your written instructions for end-of-life medical care, resuscitation preferences, and life support decisions — so your wishes are known and honored.

Healthcare Directive (Proxy Directive)

Appoints a trusted person to make medical decisions on your behalf when you cannot communicate your own wishes.

⸻ Common Questions

Power of attorney notary FAQs —
New Jersey.

Does a power of attorney need to be notarized in New Jersey?

Yes. Under New Jersey law (N.J. Stat. § 46:2B-8.9), a financial POA must be signed in the presence of a notary public to be valid. Without notarization, banks and financial institutions may refuse to honor the document. A healthcare POA or advance directive also strongly benefits from notarization.

Can a mobile notary come to my home to notarize a POA in NJ?

Yes. Trending Notary is a 100% mobile notary service that comes directly to your home, hospital, assisted living facility, or any location in New Jersey. There is no office to visit. We bring everything needed and can notarize POA documents, living wills, and healthcare directives at your location.

What is the Estate Package and what does it include?

The Trending Notary Estate Package covers all three core estate documents — Power of Attorney, a living will, and a healthcare directive — notarized in a single visit for $250 total. This is the most cost-effective option for families who want comprehensive estate planning handled in one appointment.

Can you notarize a POA at a hospital or care facility?

Yes. Trending Notary regularly travels to hospitals, rehabilitation centers, assisted living facilities, and nursing homes across New Jersey for urgent POA, healthcare directive, and living will notarizations. Call us directly for same-day hospital appointments.

What is the difference between a POA and a living will in NJ?

A Power of Attorney appoints someone to handle your financial and legal affairs. A living will (advance directive) states your wishes for medical treatment if incapacitated. A healthcare POA (proxy directive) appoints someone to make medical decisions for you. Most estate plans include all three — covered by our $250 Estate Package.

Do I need witnesses for a power of attorney in New Jersey?

New Jersey law requires a financial POA to be notarized and recommends two adult witnesses who are not named as agents in the document. Healthcare directives may use either a notary or two adult witnesses. When booking, let us know your specific document requirements and we will advise on witness arrangements.

Does Trending Notary draft POA documents?

No — Trending Notary provides notarization services only. We do not draft, prepare, or provide legal advice on POA documents. Please have your documents prepared by an elder law attorney or using a state-compliant template before scheduling your notary appointment.

How much does it cost to get a POA notarized in NJ?

Trending Notary charges $150 base rate for a POA notarization plus $25 for document printing if needed. A $25 same-day surcharge applies for same-day bookings. Our Estate Package — POA, living will, and healthcare directive in one visit — is $250 total, which is the best value for families needing all three documents.
